STATEMENT OF THE REASONS FOR THE DECISION:

 

A resolution made at the meeting of the Cabinet on 14th February 2017 enabled a decision concerning the application to be delegated to the Portfolio Holder for Planning, Development & Property, in consultation with ward members who represent the applicant neighbourhood area. 

 

When a Parish Council was applying for the whole of the parish to be designated, Regulations required a Local Planning Authority to designate the specified area as a Neighbourhood Area, if that application was considered to be valid and complete.  This application fell within the prescribed circumstances that required the Council to approve designation of the area applied for and the application was considered to be valid and complete. 

 

A four week period of public consultation had been held to publicise the application.  Twenty responses had been received, with one objection to the application.

 

The authority had eight weeks from first publicising the application to reach a decision.  The application had to be determined by Friday 27th July 2018.

 

ANY ALTERNATIVES CONSIDERED::

 

It was considered that the Council had only one option – to approve the application.

 

The Neighbourhood Planning (General) and Development Management Procedure (Amendment) Regulations 2016 came into force on October 1st 2016.  Under the Regulations, in instances including when a Parish Council is applying for the whole of the parish to be designated, the Local Planning Authority must exercise its powers under section 61G of the Town and Country Planning Act 1990 to designate the specified area as a Neighbourhood Area.  The Council was required to approve such an application once that application was considered to be valid and complete. 

 

The Localism Act set out a number of issues that an authority must have regard to in considering whether an application was valid and complete.  These issues were considered in section 7 of this report.  The application from Leek Town Council was considered to be valid and complete.

 

 

DECISION:

 

To approve the designation of the whole of the parish of Leek as a Neighbourhood Area.
