a)    The Chair confirmed that the meeting was being broadcast live to the internet and was capable of repeated viewing. The images and sound recording could be used for training purposes within the Council. The Chair had the discretion to terminate or suspend filming if it was his opinion that continuing to do so would prejudice the proceedings of the meeting. It was likely that recording cameras would capture the image of persons seated in the public gallery and that image would become part of the broadcast. Any views expressed by any speaker in the meeting were the speaker’s own and did not necessarily reflect the views of Staffordshire Moorlands District Council.

b)    Members of the Committee and Officers present were introduced by the Chair.

c)    This being the last meeting in the current 4 year administration, the Chair thanked all Members and Officers present and particularly Cllrs. Jebb and Pearce, who were not standing for re-election.

d)    Cllr. Pearce thanked the Chair for his guidance and assistance during his period in office.

                   2.  Developer asked for the Affordable Housing level to be determined by condition rather than S.106 agreement. The vital Homes England funding depended on this stipulation.

 

RESOLVED – 1. That the application be APPROVED for the reasons and based on the policies contained in the report, subject to the conditions in the report and a Section 106 Agreement to secure:

·         Off site public open space contribution based on number of bedrooms x £608.95;

·         £419,178 for primary education, £265,952 for secondary and £54,081 for sixth form, giving a total request of £621,603;

·         Contribution towards cycle stands and benches at Blythe Bridge Station £2,474;

·         Travel Plan monitoring fee of £6,430.

 

                             2. Delegate Authority to the Head of Development Services in consultation with the Chairman to approve the application subject to conditions and Section 106 as set out in the main report subject to no objection from Ecology and Highways England.

 

                            3. In the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions/informatives/planning obligations or reasons for approval/refusal) prior to the decision being issued, the Head of Development services be given delegated authority to do so in consultation with the Chairman of the Planning Applications Committee, provided that the changes do not exceed the substantive nature of the Committee’s decision.

                   2.  Legal Advisor clarified that the history of the building was NOT a material consideration, whereas the future of it as a potential dwelling WAS a material consideration with regard to the Government’s Nationally Prescribed Space Standard.

NOTED -   1.  Outline Approval granted for 121 dwellings by PAC 27 September 2018 subject to conditions and a S.106 Agreement. Affordable Housing provision to be confirmed and Education contribution secured via the S.106 Agreement.

 

                   2.  Affordable Housing provision now set at 9% of floor space.

 

                   3.  Staffs County Council (SCC) had withdrawn their request for a contribution towards land cost, retaining the ‘build cost’ requirement.

 

                   4.  LRR contained revised recommendation clarifying the above items.

 

                   5.  Ward Councillor requested that the S.106 open space provision be site-specific to Churchill Road Recreation Ground. Confirmed that, once payment had been received, Ward Councillors would be consulted on how the money should be spent.

 

RESOLVED – 1. That the application be APPROVED for the reasons and based on the policies and conditions contained in the report of 27 September 2018 and subject to a Section 106 Agreement to secure:-

·         Affordable contribution (9% of floorspace);

·         Housing to be transferred to and managed by a Registered Provider as set out and defined in the Housing & Regeneration Act 2008;

·         Private Residents Management Company to maintain all open space on site including amenity greenspace, play space, incidental open space, footpaths and cycleways;

·         Off site public open space contribution – Play - £166,411.41 (number of bedrooms 341 as 1 beds are exempt x £488.01) – Playing pitches - £210,087.75 (number of bedrooms 345 x £608.95). All to be site-specific to Churchill Road Recreation Ground;

·         Education Contribution - £386,085 for Primary education, £497,981 for Secondary Education.

 

                        2. In the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions/informatives/planning obligations or reasons for approval/refusal) prior to the decision being issued, the Head of Development Services has delegated authority to do so in consultation with the Chairman of the Planning Applications Committee, provided that the changes do not exceed the substantive nature of the Committee’s decision.

(Councillor Ellis had declared a Disclosable Pecuniary Interest and left the room, taking no part in the discussion or vote. In the absence of the Vice-Chair, Councillor Davies took the Chair.)

NOTED -   1.  Full approval was granted by PAC for the erection of 39 dwellings 15 March 2018.

 

                   2.  SCC had since withdrawn their S.106 request for contribution towards land cost, retaining the request for ‘build cost’ contribution. Members noted that delays apparently caused by SCC amendments to S.106 Agreements were frustrating developers and hampering the build process.

 

                   3.  LRR contained removal of the phrase “plus the cost of the acquisition of the necessary land” from the recommendation and an amended recommendation.

 

RESOLVED – That the application be APPROVED for the reasons and based on the policies, conditions and informatives contained in the report, subject to a Section 106 Agreement to secure:-

·         Policy compliant onsite affordable housing (13 units);

·         Offsite Play Public Open Space Contribution - £60,513.24;

·         Offsite Formal Sports Contribution - £75,509.80; and

·         Based on 39 houses the proportional contribution towards Primary School provision of this size would be £165,994 (To use the Primary Education Contribution for a new Primary School in Cheadle or to utilise the Primary Education Contribution to facilitate an increase in the number of teaching rooms at Cheadle Primary School, Cheadle (or any successor school or establishment following a change in school name or type)).

Ben Haywood presented the report which showed that 4 appeals had been lodged with the Planning Inspectorate, notably including both recent Committee refusals regarding Hillswood Lodge, 9 The Close, Leek Road, Endon.

 

There had been no appeals decided in the period in question.

 

RESOLVED – That the report be NOTED.  

162.
